Terms and Conditions of the Online Store keterlamps.com

specifying, among others, the rules for concluding sales agreements through the Store, containing key information about the Seller, the Store, and Consumer rights.

Provisions concerning a Privileged Entrepreneur apply to agreements concluded from January 1, 2021.

§ 1 DEFINITIONS

Business Days – days from Monday to Friday, excluding public holidays.

Consumer – a consumer within the meaning of the Polish Civil Code.

Account – a free-of-charge Store function (electronic service) regulated under separate terms, allowing the Buyer to create an individual account in the Store.

Buyer – any entity purchasing in the Store.

Privileged Buyer – a Consumer or a Privileged Entrepreneur.

Privileged Entrepreneur – a natural person concluding an agreement directly related to their business activity, but not of a professional nature for that person (definition applicable to agreements concluded from January 1, 2021).

Terms and Conditions – these Terms and Conditions.

Store – the online store operated by the Seller at https://keterlamps.com/.

Seller – KETERLAMPS.PL SPÓŁKA Z OGRANICZONĄ ODPOWIEDZIALNOŚCIĄ, with its registered office in Częstochowa, ul. Młynarska 17, NIP 9492257866, REGON 52354048000000, entered into the National Court Register under number 0001000194.

§ 3 TECHNICAL REQUIREMENTS

For proper functioning of the Store, the following are required:

  • a device with Internet access,

  • a web browser supporting JavaScript and cookies.

To place an order, an active email account is also required.


§ 4 PURCHASES IN THE STORE

  • The prices displayed in the Store are total prices for the goods.

  • The total order price consists of the product price and, where applicable, delivery costs.

  • The selected product must be added to the shopping cart.

  • The Buyer selects the delivery method, payment method, and provides necessary order details.

  • The order is placed upon confirmation of its content and acceptance of the Terms and Conditions.

  • Placing an order constitutes conclusion of a sales agreement.

  • A Privileged Buyer will receive confirmation of the agreement on a durable medium at the latest upon delivery.

  • The Buyer may create an Account or purchase without registration.


§ 5 PAYMENTS

The Buyer may pay via:

  • bank transfer to the Seller’s account,

  • payment platform (e.g., PayNow),

  • cash on delivery (COD).

Online payment services are provided by Blue Media S.A. (where applicable).

If prepayment is selected, payment must be made within 7 Business Days from placing the order.

The Buyer accepts electronic invoices. Acceptance may be withdrawn.

Refunds are made using the same payment method unless the Consumer agrees otherwise at no additional cost.


§ 6 ORDER FULFILLMENT

  • The Seller is obliged to deliver goods free from defects.

  • The order processing time is indicated in the Store.

  • For prepaid orders, processing begins after payment confirmation.

  • If products with different processing times are ordered, fulfillment follows the longest processing time.

  • Delivery is available only within Poland.

  • Delivery methods:

    • Courier service

    • InPost parcel lockers


§ 7 RIGHT OF WITHDRAWAL

A Privileged Buyer has the right to withdraw within 14 days without giving any reason.

The withdrawal period expires 14 days after:

  • the Buyer acquires possession of the goods,

  • or, in case of multiple deliveries, possession of the last item.

To exercise the right, the Buyer must inform the Seller by a clear statement (letter or email).

The model withdrawal form may be used but is not mandatory.


EFFECTS OF WITHDRAWAL

The Seller refunds all payments (including standard delivery costs) within 14 days from receiving withdrawal notice.

Refunds are made using the original payment method.

The Seller may withhold refund until receiving goods or proof of return.

Goods should be returned within 14 days to:
Młynarska 17, 42-200 Częstochowa, Poland.

The Buyer bears direct return costs.

The Buyer is liable only for diminished value resulting from use beyond necessary inspection.

If goods cannot be returned by regular mail due to their nature, the Buyer also bears direct return costs.


§ 8 EXCEPTIONS TO THE RIGHT OF WITHDRAWAL

The right does not apply to contracts for:

  • custom-made products,

  • perishable goods,

  • sealed goods opened after delivery for hygiene/health reasons,

  • goods inseparably combined with other items,

  • sealed audio/video/software after opening,

  • newspapers and periodicals (except subscriptions),

  • goods whose price depends on financial market fluctuations beyond Seller’s control.


§ 9 COMPLAINTS

The Buyer may file complaints under statutory warranty or guarantee (if granted).

Under warranty, the Buyer may:

  • request price reduction,

  • withdraw (in case of significant defect),

  • request replacement,

  • request repair.

Complaints should be submitted to the addresses in § 2.

If returning defective goods is necessary, the Privileged Buyer sends them at the Seller’s expense.

Complaints are processed within 14 days.


OUT-OF-COURT DISPUTE RESOLUTION

Consumers may use:


§ 10 PERSONAL DATA

The Seller is the data controller.

Personal data is processed to fulfill orders under:

  • contract performance (Art. 6(1)(b) GDPR),

  • legal obligations (Art. 6(1)(c) GDPR),

  • legitimate interests (Art. 6(1)(f) GDPR).

Providing data is voluntary but necessary to conclude a contract.

The Buyer has the right to access, rectify, erase, restrict processing, transfer data, and object.

Complaints regarding data processing may be filed with the Polish Data Protection Authority.


§ 11 FINAL PROVISIONS

  • It is prohibited to provide unlawful content.

  • Each order constitutes a separate sales agreement.

  • Agreements are concluded in Polish.

  • Disputes with non-privileged Buyers are subject to the court having jurisdiction over the Seller’s registered office.
